This website is operated by the entity identified below. Anyone contacting us, joining the whitelist, or transacting with this project is doing so with this legal entity.

2. What this project is — and what it is not

THE FOURTH BLADE is a cultural heritage and stewardship project built around a single physical artifact: an ancient Tibetan ritual dagger (Phurba), preserved and publicly exhibited under museum conditions in Barcelona, Spain.

A Non-Fungible Mark (NFM) is:

• A permanent digital record connecting a person to the artifact's documented timeline.
• A record of stewardship — a symbolic and cultural status.
• Issued at a fixed, non-variable rate. There are no rarity tiers and no multipliers.

A Non-Fungible Mark is NOT:

• Not a security, share, bond, or financial instrument. It confers no equity, no dividend, no profit participation, and no claim on any revenue.
• Not legal or fractional ownership of the physical artifact. The artifact is not transferred, divided, or pledged to holders.
• Not an investment product. No return, appreciation, resale value, or liquidity is offered, implied, or guaranteed.
• Not a redeemable claim. Contributions are not deposits and are not refundable except where mandatory consumer law requires it.

Nothing on this website constitutes financial, investment, tax, or legal advice, or a solicitation to buy or sell any financial instrument. The "1,000,000,000 USDT" figure referenced on the site is a symbolic valuation used to define the fixed issuance ratio. It is not an appraisal, not a market price, and does not represent the assessed value of the artifact.

3. Risk disclosure

Read this section before sending any funds. Participation is voluntary and entirely at your own risk.

• Total loss. You may lose the entire amount you contribute. Do not contribute more than you can afford to lose completely.
• Blockchain transactions are irreversible. Once confirmed, a transfer cannot be recalled, cancelled, or reversed by us, by you, or by any intermediary.
• Network risk. Sending funds on the wrong blockchain network, or to a wrong address, results in permanent loss. Always verify you are on Ethereum Mainnet.
• Wallet security is yours. We never ask for, receive, or store your seed phrase or private keys. Any person or message requesting them is attempting to defraud you.
• Smart contract risk. Smart contracts may contain vulnerabilities. Audit status is published in section 5 below.
• Regulatory risk. The legal treatment of digital assets varies by jurisdiction and may change. You are responsible for your own compliance and taxes.
• No secondary market is operated by us. We do not list, make markets in, or guarantee any trading venue for NFMs.

PARTICIPATION RESTRICTIONS — confirm with counsel and list here the jurisdictions you exclude, and state whether you are subject to MiCA (EU) obligations given the Barcelona establishment.

4. Privacy Policy

We are established in Spain, so the EU General Data Protection Regulation (GDPR) applies to this website.

4.1 What we collect

• Email address — only when you voluntarily submit the whitelist form.
• Public wallet address — only if you voluntarily provide one, or when you connect a wallet to the site.
• Local browser storage — your chosen language, colour theme, whitelist status and last connected wallet address are stored in your own browser (localStorage). This data stays on your device and is not transmitted to us by that mechanism.

We do not collect your name, postal address, phone number, payment card data, seed phrases or private keys. We do not use advertising trackers, and we do not sell or rent personal data to anyone.

4.2 Cookies and third parties

This website sets no advertising or analytics cookies. It does load two third-party resources which, by the nature of an HTTP request, receive your IP address: Google Fonts (fonts.googleapis.com, fonts.gstatic.com) and Cloudflare's cdnjs (cdnjs.cloudflare.com). If you connect a Web3 wallet, that wallet extension or app is operated by its own provider under its own privacy policy.

IF YOU ADD ANALYTICS LATER — you must add a GDPR-compliant consent banner before any non-essential script loads, and update this section. Self-hosting the fonts removes the Google Fonts IP-transfer issue entirely.

4.3 Legal basis, retention and your rights

We process whitelist data on the basis of your consent (Art. 6(1)(a) GDPR), and transaction-related data where necessary to perform our undertakings to you (Art. 6(1)(b)). Whitelist data is retained until the whitelist programme concludes or you ask us to erase it, whichever comes first.

Under the GDPR you have the right to access, rectify, erase, restrict, port, and object to the processing of your personal data, and to withdraw consent at any time. To exercise any of these, email the contact address in section 6; we respond within 30 days. You also have the right to complain to your national supervisory authority — in Spain, the Agencia Española de Protección de Datos (AEPD).

5. Terms of Use

5.1 Eligibility

You must be of legal age in your jurisdiction and legally permitted to use digital assets there. You must not be a resident of, or located in, a jurisdiction subject to comprehensive sanctions, and you must not appear on any applicable sanctions list.

5.2 Smart contracts and current deployment status

The contract addresses published on the main page reflect the current, live deployment state. Until a contract address is published as deployed and verified on Etherscan, no on-chain issuance mechanism exists.

MUST MATCH REALITY — the site currently shows placeholder addresses (0x000…000) while the payment button performs a live USDT transfer. Publish deployed + Etherscan-verified addresses, and the audit report, before enabling payments. Stating a status here that contradicts the on-chain facts is the fastest route to a browser block.

5.3 Acceptable use

You agree not to use this website to break any law, to impersonate the project or its representatives, to interfere with its operation, or to attempt unauthorised access to any system.

5.4 Intellectual property

The site design, text, and imagery are the property of the operator identified in section 1, except where third-party material is credited. The physical artifact is a historical object; no claim of authorship over it is made.

5.5 Limitation of liability

To the maximum extent permitted by applicable law, the operator is not liable for indirect, incidental, or consequential loss arising from use of this website, from blockchain network behaviour, or from third-party wallet software. Nothing here excludes liability that cannot lawfully be excluded, including liability for fraud, or mandatory consumer rights under Spanish and EU law.

5.6 Governing law

These terms are governed by the laws of Spain, and the courts of Barcelona have jurisdiction, without prejudice to any mandatory consumer protection rights you hold in your country of residence.
